The Swedish Administrative Court of Appeal has rejected SafeEnt’s latest appeal against its licence revocation, upholding the decision by the regulator to withdraw the permit for commercial online gambling and betting.

Global Gaming, of whom SafeEnt is a subsidiary which runs the igaming entity Ninja Casino alongside spellandet.com, will not lodge a further appeal to the Supreme Administrative Court – as is a permitted course of action.

The court judged that the company “has during the current time violated provisions in the Gaming Act on deposit limits for online games, customer contact, bonus offers and measures against money laundering”. Due to this, it says that there is reason for intervention under the Gaming Act.

Overall, the board of Global Gaming commented that it “welcomes the fact that the ruling has now been announced, and a consequence of this is that clear and distinct conditions for Global Gaming’s future operations now also exist”.

It adds that due to operational adjustment made following the Spekinspektionen’s decision, it is of the opinion that this latest judgement will have “no impact” on current or planned activities.

Speaking in a statement on behalf of the board of Global Gaming, it was added: “This has been a process that the company’s current newly appointed board inherited. The board has taken note of today’s judgment, and fully shares the views expressed by both the Administrative Court of Appeal and the previous court and thus also the Spelsinspekionen in the case.

“The board would like to point out that it took office only a few weeks before the hearing in the Court of Appeal, and in the then and still ongoing bidding process that Global Gaming is undergoing, measures that can be interpreted are of such a nature that they may undermine the value of the shares. In this case, companies under acquisition, not suitable or may be prohibited.

“Due to this, there was no reasonable opportunity for the board to stop the ongoing case even before the hearing in the Court of Appeal.”

On June 17, 2019, the Spelinspektionen revoked the licence of Global Gaming’s SafeEnt subsidiary related to the provision of betting and commercial online gaming in Sweden.

This was subsequently appealed to the Administrative Court and rejected; a decision which prompted a further appeal to the Administrative Court of Appeal.

“We have made a balance between the circumstances that speak for and against the revocation of the license. In this case, we consider that a warning is not a sufficient measure. The Spelinspektionen’s decision to revoke the company’s license should therefore not be changed,” noted Anders Poulsen, councillor of the Court of Appeal.

The Spelinspektionen welcomes the decision of one of “great importance” for the re-regulated gaming market, adding: “All licensed players must follow the existing rules. 

“It is particularly important that rules of great importance for the protection of consumers are complied with. If we are to ensure a healthy and safe gaming market, we must exclude those players who do not comply with essential parts of current regulations”.

Embattled Global Gaming has unveiled a new Swedish facing brand alongside Finnplay, as the firm strives to maintain a presence in its home market despite ongoing struggles.

NanoCasino’s launch marks the first step in its new partnership with Helsinki-based Finnplay that was first announced last week, which came a day after Global Gaming’s wholly owned subsidiary SafeEnt received a further set-back.

The company, licensed for its flagship Ninja Casino brand and spellandet.com site within the country, has had its licence revoked by Sweden’s gaming regulatory Spelinspektionen.

Two subsequent appeals were launched and rejected by the Administrative Court and its Chamber of Appeal, with SafeEnt, which is seeking injunctive relief to continue operating until a final decision is reached, considering taking its case to the Supreme Administrative Court.

NanoCasino is to be operated by Finnplay’s subsidiary Viral Interactive, which holds a Swedish Gambling Authority licence for online gambling.

SafeEnt, a wholly owned subsidiary of Global Gaming, has seen a further appeal refused regarding its licence revocation in Sweden, and is now considering taking its case for injunctive relief to the Supreme Administrative Court.

The company, licensed for its flagship Ninja Casino brand and spellandet.com site within the country, has seen the Administrative Court’s Chamber of Appeal in Jönköping confirm that the revoking is be imposed until further notice, while a final decision on the revocation is being tested. 

Spelinspektionen, the Swedish regulator, withdrew the licence last month, stating that it had discovered “serious deficiencies” in the company’s operations, and that it had violated key provisions of the gaming law.

One example particular example highlighted that customers had been able to spend large amounts of money without the company reacting to what the duty of care requires, in addition to individuals being able to play well beyond their own deposit limits.

Furthermore, it was revealed that actions against money laundering and terrorist financing also showed serious and systematic shortcomings, with deficiencies found in the company’s risk assessment and measures for customer knowledge.

SafeEnt swiftly announced its decision to appeal to decision in Administrative Court, requesting that the decision should not apply while a final judgement is still being sought.

Håkan Löfgren, chairman of the court, said of the decision: “The judgement is based on an assessment of the likelihood that the license will be revoked definitively. 

“The decision means that the company cannot offer games as long as the process in the administrative court is ongoing. What is happening now is that the parties will complete their action in the Administrative Court. The administrative court then has to decide the case finally, ie. decide if the recall should pass.”

Having now seen two appeals being refused, the next step in the process would be to contest the judgement in the Supreme Administrative Court, a course of action being considered.

Tobias Fagerlund, Global Gaming CEO, commented on the rejection of injunctive relief: “We are of course disappointed by the ruling of the Administrative Court of Appeal and the fact that relief was not conceded. We and our shareholders suffer a great deal of damage for every day operations are suspended.

“It is still our conviction that we will prevail at the end of the process. We are currently considering options for an appeal for injunctive relief in the Supreme Administrative Court.”

The board of directors of Global Gaming has confirmed the appointment of Tobias Fagerlund as the president and CEO with immediate effect.

Coming in the midst of a tumultuous period for the Sweden-based gaming company, it cements the position that Fagerlund has held in an acting capacity since Monday 29 April of this year.

Sweden-based gaming company Global Gaming is seeking a new auditor, after current incumbent KPMG notified the firm of an early termination of its assignment.

The embattled organisation, that is currently undergoing an appeal of a licence revocation in Sweden, stated that KPMG, led by auditor-in-charge Jonas Nihlberg, has this week elected to call an early termination of its audit contract.

In a media statement it was commented that “the company has reviewed the auditing firm’s letter and it is clear that the auditing work carried out by KPMG for 2019 has not given rise to any issues on the part of the auditor”.

The process of finding a new auditor will begin immediately, with the company electing call an extraordinary general meeting with a view to filling the void as soon as possible.

Tobias Fagerlund, acting CEO of Global Gaming, remained defiant in the face of its ongoing Swedish dispute and KPMG withdrawal: “Today’s message from our auditors at KPMG came as a surprise. Whilst we understand that the case against the gambling authority might raise questions and concerns, it is our conviction that the ongoing case will ultimately show that the gambling authority’s decision was incorrect and disproportionate. It is unfortunate that their decisions should have side effects of this kind.” 

Earlier the month Swedish regulator Spelinspektionen revoked the licence of Global Gaming subsidiary SafeEnt, after discovering “serious deficiencies” in the company’s operations.

The regulator commented that following a review SafeEnt was found to have “violated several of the most central parts of the game law,” which are aimed at protecting players against excessive gambling.

Bringing an end to its flagship Ninja Casino and spellandet.com entities in the Swedish market, the company issued its intent to appeal spearheaded by a belief that compliance with the new regulations was being met.

A further blow was dealt by the Administrative Court, however, after announcing that the ban will stand while the decision to revoke the company’s license is being tested.

Sweden’s Administrative Court in Linköping has rejected an appeal by SafeEnt, who has been stripped of its licence within the country and was ordered to cease operations immediately.

Agreeing with the stand taken by regulator the Spelinspektionen, it was previously stated that “serious deficiencies” were found in the company’s operations.

Announcing the decision by the court that the ban will stand while the decision to revoke the company’s license is being tested, the Spelinspektionen believes that the risks for the customers would be too much should the company were allowed to conduct gaming operations, and therefore welcomed the decision of the Administrative Court.

Last week the Spelinspektionen revoked licenses of SafeEnt, which runs Ninja Casino and spellandet.com, after the authority announced it had discovered, among other things, serious shortcomings regarding gambling responsibility and the work against money laundering.

Announcing a decision to appeal Tobias Fagerlund, acting CEO at Global Gaming, of which SafeEnt is a wholly owned subsidiary, said: “The information this morning from the gaming authority came unexpected, due to that the company is under the impression that we comply with the regulations which the new legislation has set on gaming operators in Sweden. That they come with this decision is odd.”

Adding: “We will of course appeal the decision and have good reasons to believe that we will have success in an appeal. That the license now have been revoked lacks legal support and compose an unproportional action which will cause the company significant damage.”

Earlier this week the Spelinspektionen also issued a SEK 700,000 (£58,691) penalty against Lottoland, for offering products not covered by the licence it possesses in Sweden.

As a result of a review, United lottery Solutions, operator of the lottoland.se portal, was found to have permitted betting on the lottery Eurojackpot, which is licensed by the state-owned Svenska Spel in Sweden  

Not gaining permission from the firm to allow players to bet on the lottery outcome, Lottoland was also found to be offering scratch cards online, representing a further licence violation.

The regulator comments that Lottoland has revised its offering, but that violations have been going on for a sufficient period of time to warrant such a penalty.

The fee is based on the severity of the infringement and the company’s turnover on the Swedish market, with the company also warned of a more severe outcome should further violations ensue.

Global Gaming has issued a response to a licence revocation by Swedish regulator the Spelinspektionen, by stating its intention to appeal the decision.

The company’s subsidiary SafeEnt, which runs the igaming entity Ninja Casino alongside spellandet.com, lost its Swedish licence for commercial online gambling and betting earlier in the day.

However, Global Gaming, and its legal advisors, stress an impression that all demands to hold a license are complied with.

The company also states that its legal team is under the firm impression that the Gaming Authority’s decision lacks support in the gaming law, which will subsequently see the firm appeal the ruling.

SafeEnt, it is said, has been under a period of dialogue with the Swedish Gaming Authority concerning the shortcomings, with the products “for the time being” having been discontinued within the country.

Sweden-based gaming company Global Gaming is searched for its second new chief executive officer in less than twelve months, following news that Joacim Möller is to leave the role within the group with immediate effect.

Möller, who previously held the position of chief operating officer, replaced Stefan Olsson in April last year, with company director Tobias Fagerlund now having been installed as a temporary acting CEO.

In a media release, Global Gaming confirmed that work on recruiting a new permanent CEO has begun with immediate effect, with an increase in Swedish regulatory costs blamed for creating a company slowdown, which would see the operator undertake a new review of balances and costs.

It was stated that: “The change that the Swedish gaming market goes through after the new legislation came into force at the beginning of the year is extensive. It has led to major changes for all gaming operators in the Swedish gaming market, not least for Global Gaming.

“It is the board’s opinion that Global Gaming is a fundamentally strong company with great potential to continue to be a significant player in the Swedish market.

“In order to succeed, the company’s adaptation to be further intensified. It is the board’s opinion that the extensive work and the way forward needs a new leadership.”

Last month SafeEnt, a subsidiary of Global Gaming and home to Ninja Casino, extended its partnership with payment services provider Trustly.

Through Trustly’s Pay N Play product, the extended agreement cemented Trustly as Global’s payment services provider for Ninja Casino in Sweden and into new markets, including Finland and Estonia.
